Welcome to Faithful Athlete. These Terms of Service ("Terms") govern your access to and use of our mobile application, website, and related services (collectively, the "Service"). By accessing or using Faithful Athlete, you agree to be bound by these Terms.

If you do not agree to these Terms, you may not use our Service. If you are under 18, you represent that you have obtained parental or guardian consent to use the Service and agree to these Terms.

2. Description of Service

Faithful Athlete is a faith-based mental performance app designed for youth, high school, and college athletes. Our Service provides:

• Daily check-ins for emotional and mental state tracking
• Personalized biblical affirmations and scripture
• Access to a verse library organized by themes
• Prayer journal functionality
• Streak tracking and progress monitoring
• Sport-specific encouragement and support

3. User Accounts

3.1 Account Creation

To use certain features of the Service, you must create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and update your account information as needed
• Maintain the security of your account credentials
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized access

3.2 Account Eligibility

You must be at least 13 years old to create an account. Users under 18 must have parental or guardian consent. Users under 13 may use the Service with verified parental consent and supervision.

4. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree NOT to:

5.1 Free and Premium Services

Faithful Athlete offers both free and premium subscription tiers:

• Free Tier: Includes 3 check-ins per week and access to 50 verses
• Premium Tier: Includes unlimited check-ins, 500+ verses, and advanced features

5.2 Payment Terms

If you choose to subscribe to Premium:

• Payment is processed through the Apple App Store or Google Play Store
• Subscriptions automatically renew unless cancelled
• You can cancel your subscription at any time through your device's app store settings
• Refunds are subject to the policies of the app store where you purchased the subscription
• We reserve the right to change subscription prices with advance notice

6. Intellectual Property

The Service, including its original content, features, functionality, design, and branding, is owned by Faithful Athlete and protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to access and use the Service for personal, non-commercial purposes. You may not:

• Copy, modify, or create derivative works of the Service
• Reverse engineer, decompile, or disassemble the Service
• Remove any copyright or proprietary notices
• Use our trademarks or branding without permission

Scripture content is primarily from The Message Bible. All scripture is used in accordance with fair use and copyright permissions.

7. User Content

You retain ownership of any content you create, upload, or submit through the Service (such as journal entries and check-in responses). By using the Service, you grant us a license to:

• Store, process, and display your content to provide the Service
• Use anonymized, aggregated data for analytics and improvement

You are solely responsible for your content and represent that you have all necessary rights to share it. We reserve the right to remove any content that violates these Terms.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability or fitness for a particular purpose
• Warranties that the Service will be uninterrupted, secure, or error-free
• Warranties regarding the accuracy or reliability of content

Faithful Athlete is a mental and spiritual support tool and is not a substitute for professional medical, psychological, or therapeutic advice. If you are experiencing a mental health crisis, please contact a mental health professional or emergency services immediately.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FAITHFUL ATHLETE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of profits, data, or use
• Personal injury or property damage
• Damages resulting from your use or inability to use the Service

Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify, defend, and hold harmless Faithful Athlete and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Service, violation of these Terms, or infringement of any rights of another.

11. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for any reason, including:

• Violation of these Terms
• Fraudulent, harmful, or illegal activity
• Extended periods of inactivity
• At our sole discretion

You may terminate your account at any time by deleting the app or contacting us. Upon termination, your right to use the Service will immediately cease, and we may delete your account and data in accordance with our Privacy Policy.

• Sending you a notification through the app (for significant changes)
